Terms of Service
Effective: March 24, 2026
Agreement
By using Nemorith, you agree to these terms. If you do not agree, do not use the software. Nemorith is free and open source software published under the GNU Affero General Public License version 3.0 (AGPL-3.0). Your use of the source code is additionally governed by that license.
What Nemorith Is
Nemorith is a personal financial management tool. It helps you track budgets, accounts, debts, investments, insurance, estate documents, and trust governance in one place. It runs on your device, stores data locally, and encrypts sensitive content with AES-256-GCM.
What Nemorith Is Not
Nemorith is not a financial professional, tax professional, legal professional, or licensed fiduciary. It does not provide financial advice, tax advice, investment advice, legal advice, or any form of personalized professional guidance.
All calculations, projections, simulations, scores, and recommendations generated by Nemorith are for informational and educational purposes only. This includes but is not limited to:
- Retirement readiness scores and projections
- Monte Carlo simulations and probability estimates
- Debt payoff timelines and interest savings calculations
- Tax bracket visualizations and Roth conversion analysis
- Social Security claiming strategy comparisons
- Insurance coverage gap analysis
- Estate planning scores and checklists
- FIRE calculations and net worth projections
- Portfolio rebalancing suggestions
These tools help you understand your financial picture. They do not replace the judgment of qualified professionals who understand your specific situation. Always consult a qualified financial professional, tax professional, or legal professional before making significant financial decisions.
Trust and Estate Features
Nemorith includes features for tracking trust lifecycle stages, member roles, succession plans, and ownership structures. These features help you organize and visualize your trust governance. They are record-keeping and planning tools, not legal instruments.
The information you enter into Nemorith about your trust does not create, modify, or replace any legal document. Your actual trust documents, as prepared by your attorney, are the governing authority. If there is ever a discrepancy between what Nemorith shows and what your legal documents say, your legal documents control.
Your Responsibility
You are responsible for:
- The accuracy of the data you enter into Nemorith
- Your own financial decisions, regardless of what the app calculates or suggests
- Maintaining backups of your data (Nemorith provides encrypted backup export, but you must actually do it)
- Keeping your device, PIN, and encryption passwords secure
- Evaluating whether any calculation or projection is appropriate for your situation
- Consulting qualified professionals when needed
Data and Backups
All Nemorith data is stored locally on your device. We do not have access to your data, and we cannot recover it if you lose it. If you uninstall the app, clear your browser data, lose your device, or forget your encryption password, your data may be permanently gone.
Nemorith provides tools to create encrypted backups. Using them is your choice and your responsibility. We strongly recommend regular backups stored in a secure location separate from your primary device.
No Warranty
Nemorith is provided "as is" and "as available" without warranty of any kind, whether express, implied, statutory, or otherwise. This includes, without limitation, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the software will be error-free, uninterrupted, secure, or free of harmful components. We do not warrant the accuracy, completeness, or reliability of any calculations, projections, or outputs. Financial calculations involve assumptions and simplifications that may not reflect your actual situation.
Limitation of Liability
To the maximum extent permitted by applicable law, the Ninth Star Foundation, its contributors, and its maintainers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your use of Nemorith.
This limitation applies whether the damages arise from:
- Use or inability to use the software
- Financial decisions made based on the software's calculations or outputs
- Data loss, corruption, or unauthorized access on your device
- Errors in calculations, projections, or simulations
- Interruption or failure of sync, backup, or import features
- Actions of third-party services (SimpleFIN, market data providers, etc.)
In no event shall our total liability exceed zero dollars ($0.00). This is free software. The price reflects the extent of our financial obligation.
Third-Party Services
Nemorith optionally integrates with third-party services that have their own terms and policies:
- SimpleFIN - Bank transaction sync. You contract with SimpleFIN directly. Their terms, pricing, and privacy practices are their own.
- Finnhub / Alpha Vantage - Market data providers, accessed through api.ninthstar.org. If you supply your own API keys, those providers' terms apply to your usage.
We are not responsible for the availability, accuracy, security, or conduct of any third-party service.
Open Source License
The Nemorith source code is licensed under AGPL-3.0. You are free to use, modify, and distribute the source code under the terms of that license. The full license text is included in the source repository at codeberg.org/NinthStarFoundation/nemorith.
Commercial Licensing
If the AGPL-3.0 license does not meet the needs of your organization, commercial white-label licensing is available separately. Contact the Ninth Star Foundation for details.
Acceptable Use
You agree not to use Nemorith for any purpose that is illegal under applicable law. The software is a financial management tool. Use it for managing finances.
Indemnification
You agree to indemnify and hold harmless the Ninth Star Foundation, its contributors, and its maintainers from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of Nemorith or your violation of these terms.
Governing Law
These terms are governed by applicable law in the jurisdiction where any dispute arises. If any provision of these terms is found to be unenforceable, the remaining provisions continue in full force.
Changes to These Terms
The Ninth Star Foundation reserves the right to update these terms at any time. Updated terms will be posted on this page with a new effective date. Continued use of Nemorith after changes are posted constitutes acceptance of the updated terms.
